Before proceeding it’s important that you read these Terms and Conditions of Sale carefully. These conditions are the basis upon which bookings are accepted by MajesTix. If you do not agree with the following Terms and Conditions of Sale then please do not proceed with your booking.

MajesTix and Hermaj.com (collectively, the Site) is an online service owned and operated by City of Ballarat through Her Majesty’s Theatre (ABN 37 601 599 422) (MajesTix, we or us). MajesTix is offering its services to you as event ticketing to theatre and concerts presented by us and our hirers. When MajesTix sells a ticket of admission, MajesTix warrants it is fully authorised to sell the ticket(s).

Terms & Conditions of Sale

These terms may vary at MajesTix discretion, and will be effective upon posting to the Web Site and available to view at the MajesTix Box Office, Her Majesty’s Theatre, 17 Lydiard Street South, Ballarat. You must agree to them, and any current variations to them, each time you make a purchase from us.

No Cancellations, Exchanges or Refunds.

Once confirmed, bookings may not be cancelled, exchanged or refunded except as required by law or as detailed in these Terms and Conditions. MajesTix can not take responsibility if you do not or cannot attend the performance(s) confirmed in your booking.
A contract will be made between MajesTix and yourself upon confirmation of your booking. Bookings are confirmed when full payment is received. Confirmation of your booking will be sent to the e-mail address that you provided.

Age Limit for Children Not Occupying a Seat

Unless a producing company has specifically requested otherwise MajesTix will admit free, with no seat allocated, Children 3 years and under for adult style productions, and for children’s style productions free admission will be offered to children 18 months and under.  Such children will be expected to sit with their guardian in a paid for seat for the duration of the performance and not occupy a separate seat.

Confirmation e-mail.

For online bookings an automatic booking confirmation will be sent by e-mail and will include the show times, ticket specifics and other details of your order. This e-mail will be sent within 60 minutes of payment being received. You must notify MajesTix immediately if there have been any mistakes with your booking, or if you do not receive the confirmation e-mail after an hour.

No Reselling.

No tickets may be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promoting orother commercial purposes (including competitions or trade promotions) or to enhance the demand for other goods or services, either by yourself or another person without express consent of MajesTix. If a ticket is involved in a breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission.

Price Changes.

All prices are subject to change without prior notice until your booking is confirmed.

Refunds for event cancellation.

If an event is cancelled or postponed before it begins we will provide a refund to you. The amount of your refund will depend on the change and cancellation policies of the supplier(s) of the ticket that you bought.

If an event is cancelled or postponed after it has commenced, you will not have the right to exchange or receive a refund on tickets.

GST.

All prices quoted include the Goods and Services Tax (GST) where applicable.

Ticketing Code of Practice

MajesTix strictly abide by the “Code of Practice for the Ticketing of Live Entertainment in Australia” defined by the industry regulatory association, Live Performance Australia.

 

MajesTix Pricing Policy.

All stated prices are inclusive of GST. MajesTix’s advertised ticket prices include the base supply cost of the products and all fees charged to and by MajesTix to supply those tickets and packages. All prices are subject to change upon any changes in applicable taxes.

Lost Tickets.

If your allocated seating tickets are lost or stolen you must produce proof of their original purchase before we will issue a Lost Ticket Voucher. Replacement of lost tickets is subject to the venue and/or promoter’s terms and conditions. MajesTix may charge an administration fee if a lost ticket voucher needs to be issued. MajesTix reserves the right not to replace tickets where seating is not allocated (general admission).

Independence.

MajesTix is an independently owned and operated business. It is not our intention at any point to imply that MajesTix is endorsed, sponsored, approved or otherwise affiliated with the presenters or sponsors of any event, except to the extent of being a booking intermediary/agent or as explicitly promoted, except where an event is promoted by Her Majesty’s Ballarat.

Law & Construction.

These Terms and Conditions of Sale, any contract made by a confirmed booking and all directly related matters shall be governed and interpreted exclusively under the law and courts of the State of Victoria, Australia.

Personal information and privacy.

In order to make your booking MajesTix will need to gather some personal information such as your name, address and credit card details. MajesTix will keep your personal information secure and confidential, and will not sell your information to any third party. We follow Australia’s privacy laws and our own Privacy Policy in all our dealings with you. To view our policy, please go to www.hermaj.com/venue/privacy-policy.

Normally your purchase will only be provided to you, the purchaser. You may assign your purchase to another person, but you must tell us the name of the intended recipient as part of the order process or using the contact details in your confirmation e-mail. If you do not do this, our privacy policy means that we cannot discuss your purchase with that person and the products or services may not be provided to them. By naming the recipient you give us permission to discuss the details of the booking with that person.

Uncontrollable events.

Certain things lie outside MajesTix control and many situations are unavoidable or not reasonably predictable. Except as required by law, MajesTix is not liable for any loss, inconvenience, damage, additional expense, injury, delay or any other claim in relation to:

a. Changes to event information, programme, performers or performance dates, including the cancellation or rescheduling of events;

b. actions or omissions on the part of independent promoters or others outside of MajesTix control, who supply products and services in connection with ticketed events;

c. unknown or unforeseen defects in any venue, vehicle, device or material used in connection with products sold by MajesTix;

d. promoter policies or legal regulations including, but not limited to: dress standards, bans on cameras and recording devices, the responsible service of alcohol and safety regulations; or

events which are unforeseeable or not preventable by reasonable diligence on our part including, but not limited to: war, fire, floods, unusually severe weather, acts of God, acts of Government, acts of terrorism, accident, failure of machinery, labour disturbances and acts or omissions of telecommunications and delivery service operators beyond our reasonable control.

Unenforceability.

These Terms are not intended to limit your mandatory legal rights and should be read as such. If any part of these Terms is held to be invalid, illegal, unenforceable or in conflict with the law of Victoria it will be disregarded to the extent of its invalidity and the remainder will remain in full force and effect.
